Welcome to Eira FZ LLE (”Eira”). By accessing or using our website, you agree to comply with and be bound by the following terms of use and conditions (the “Terms”). Please read them carefully.

1. Acceptance of Terms

By accessing, browsing, or using this site, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you may not use this site.

By purchasing any products you confirm that you accept these Terms and agree to comply with them. We may amend these terms from time to time. Every time you wish to purchase any products on our website, please check these Terms to ensure you understand the terms that apply at that time.

2. Eligibility

We do not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 21 you may purchase the products only with the involvement of a parent or guardian.

3. Account Registration

To make purchases, you may be required to register an account. You are responsible for maintaining the confidentiality of your account information and password, and you agree to accept responsibility for all activities that occur under your account.

4. Product Descriptions

We strive to ensure that product descriptions are accurate. However, you should note that the images are for illustrative purposes only and your product may vary slightly from those images.

5. Orders

Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

6. Pricing and Payment

Prices for our products are subject to change without notice. We reserve the right at any time to modify the price. All payments must be made in full at the time of purchase via the accepted payment methods. We are not responsible for any transaction fees or currency conversion fees imposed by your financial institution.

7. Shipping and Delivery

We aim to ship your orders as soon as reasonably possible and in any event within 30 days after the day on which we accept your order. However, delivery times are estimates and may vary based on location and external conditions. We are not responsible for any delays in shipping due to unforeseen circumstances.

The costs of delivery will be as displayed to you on our website. For any overseas deliveries, there may be additional import tax/duty, depending on the size and value of the goods, which you shall be responsible for paying.

During the order process we will let you know when we will provide the products to you.

If our supply of the products is delayed by an event outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event.

8. Returns and Refunds

  • Digital Products. We do not offer refunds on digital product purchases.
  • Physical product/goods. You have 14 days after the day you (or someone you nominate) received the products

You have a right to receive a full refund for faulty goods; goods not fit for purpose; or goods that are not as described. Your refund shall include any reasonable delivery costs.

If you wish to receive a refund for faulty goods, you must send them back to us. We will pay the reasonable costs of postage or collection.

You will have 30 days from the date the product is delivered to you to let us know that there is a problem and whether you would like a refund or a replacement. Once we have acknowledged that you would like a refund or a replacement, we shall provide such a refund or replacement within 14 days from when we receive the returned goods. If you have asked for a replacement and the replacement is still faulty, you will have 6 months to either get a refund or ask for a price reduction.

9. User Conduct

You agree not to use this site for any unlawful or prohibited purpose. You may not:

  • Interfere with the security of the website or its services.
  • Engage in fraudulent activity or attempt to impersonate another individual.
  • Submit false or misleading information.

10. Digital Products License

By purchasing any digital product from Eira, you are granted a limited, non-transferable, non-exclusive license to access and use the product on up to two devices. The digital content may not be reproduced, shared, distributed, or transferred to others. Furthermore, digital products are not printable unless explicitly stated otherwise. Violation of these terms may result in the termination of your license without a refund.

11. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Eira or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or use any content without our express written consent.

12. Limitation of Liability

To the fullest extent permitted by law, Eira shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of this website or products purchased through it.

Eira will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time.

13. Customs

When ordering products from Eira for delivery outside of the UAE you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

14. Changes to Terms

We reserve the right to make changes to these Terms at any time. Any changes will be posted on this page with an updated date. Continued use of the site after any changes constitutes your acceptance of the new Terms. If any of these Terms is deemed invalid, void, or for any reason unenforceable, that term will be deemed severable and will not affect the validity and enforceability of any remaining condition.

15. Governing Law

These Terms shall be governed by, and construed in accordance with, the laws of the Dubai International Financial Centre (the “DIFC”). Any disputes arising out of or in connection with these Terms or any products or services sold by Eira, qualifies for determination through the DIFC Small Claims Tribunal (the “SCT”), then the SCT shall have exclusive jurisdiction to settle any such dispute. For disputes that do not qualify for determination through the SCT, the courts of the DIFC shall have exclusive jurisdiction to settle such dispute and each party submits to the exclusive jurisdiction of the courts of the DIFC. For the purposes of this section, you waive any objection to either the courts of the DIFC or the SCT, as applicable, on the grounds that either of them is an inconvenient or inappropriate forum to settle any dispute.
